AgriShare Privacy Notice

We, Zimbabwe Welthungerhilfe, take the protection of your personal data seriously. We treat your personal data confidentially and, naturally, in accordance with statutory data protection regulations and this Privacy Notice.

1. General Information

In this Privacy Notice, we explain the kind, scope, and purpose of the processing of personal data within the Agrishare application, its related websites, functions, and content (hereinafter referred to as “AgriShare”). This Privacy Notice applies regardless of the individual domains, systems, platforms, and devices (e.g., desktop or mobile devices) on which our online services are accessed.

Terms such as "personal data" or the "processing" of the same are defined as per § 4 of the General Data Protection Regulation (GDPR). We process our users’ personal data only in accordance with the relevant data protection regulations. This includes processing the users’ personal data on a legal basis, based on the users’ informed consent (§ 6.1(f) GDPR); based on our legitimate interests (§ 6.1(f) GDPR) if so required i.e., interests of analysis, optimisation, and commercial operation and security of our online services; or to fulfil our legal obligations (§ 6.1(c) GDPR).

In this context, the term “user” comprises all categories of persons affected by the data processing; this includes visitors of our website and user of the AgriShare application. The terms used, e.g., “user”, are gender neutral.

2. What is your “personal data?”

We define “personal data” as any data or information that directly identifies you such as:

your given name, date of birth, gender and your preferred language
your financial information, this includes your bank account, your mobile money number
your national identity number, or any identifying number assigned to you, including membership numbers or promotional numbers
your personal opinions on or views or preferences on how you use our products and services, collected during marketing or opinion surveys
your phone number used to register for our products and services, including any numbers listed for sending or receipt of information, or transactions, message services, and voice calls.
your email address used to register for our products and services, including any email address listed on our mailing lists for promotional or marketing or other related services.
your consent records as you may have given to allow us to collect the above information,

We also treat other data that does not directly identify you but that can be reasonably used to identify you, the same way we treat your personal data for example,

your device’s IP address
your device registration details, International Mobile Equipment Identity (IMEI)
your subscriber identification module (SIM) card number
your device location coordinates

3. How do we collect data from you?

We only collect necessary data that we need to ensure that AgriShare remains a great product. These are the ways in which we collect personal data with your consent:

when you create an account by providing your name, date of birth, and location, and any other personal identifiable information including your national identity numbers, your phone number, or email addresses
when you open the AgriShare mobile phone App, as it will immediately collect the information about your location, whether you are transacting or not
when the App requests access to your location data to ensure relevant listings to your geographical location
when you search listings offering equipment for hire, add listings for equipment for hire, send and receive notifications
when you make a booking for services and goods listed in the App
when you add your mobile money details, your banking details or account information.
when you transact on the AgriShare service, we will know your mobile money number and the transactions you carry out
when you interact with our platforms, website and applications even if you are not a customer or have registered an account

The data we have includes the following categories of information:

Account Information. Your AgriShare account details, including email address, location, devices registered, and account status.
Device Information. Data about your device such as device serial number, location and device model
Transaction Information. Data about transactions purchases you make on the AgriShare and any other transactions facilitated on the platform.
Usage Data. Data about how you use the AgriShare App and from the Apps information/ hosting website, including navigation history; search history; crash data, performance and other diagnostic data; and other usage data.
User experience: opinion surveys, response to queries or any information you volunteer in respect of the use of our platforms
Online Marketing: through our marketing campaigns, on online search facilities, webpages, email. This information is collected by ads based on clicks, including the device used
Social media usage: by looking through the list of social media users following our pages, we will collect your social media contacts, to enhance our understanding of our target audience whether you are a customer or not.

4. What do we do with your data once we have it?

We use your data to for the specific reasons that it was collected for, as this is consistent with the provisions of the data protection laws to;

avail services offered on our platforms, and applications
help us provide and improve our software and services for you.
helps us connect you to service providers, and third-party service providers
help us disseminate our AgriShare performance reports, and for AgriShare promotional purposes without disclosing your personal data
comply with all relevant local laws that require collection of some personal information, such as the Banking Act, associated regulations, Know Your Client (KYC),
implement security, and safety measures to prevent and detect fraud, other online crimes, such as identity theft,
improve our relationship management with you as a client, on services and products, and for development and improvement of the products and services, to meet your experiential needs,
undertake internal reporting and implement business controls.

5. When do we share your data with others?

Data generated from the use of the App is also accessible to our development partner the Community Technology Development Organisation (CTDO).

We also employ any external service providers to provide our services, this is done in accordance with the stipulations of § 28 GDPR. We have concluded a limited-processing contract with each data processing company to ensure that your personal data are processed according to their purpose and not shared. We also take appropriate technical and organisational measures to protect your personal data.

Insofar as contents, tools, or other materials are employed within the framework of this Privacy Notice by other providers (hereinafter collectively referred to as “Third-Party Providers”) registered in a third country, it must be assumed that data are being transferred to the Third-Party Provider's country of record. Third countries are countries in which the GDPR is not directly-applicable law—categorically, this includes countries outside of the European Union and the European Economic Area. Data may be transferred into third countries in the presence of the appropriate data protection level, user consent, or another form of statutory authorisation.

Where the law requires it, for example during a criminal investigation we will be obliged to turn over information that may include personal information to the investigating entities once we are reasonably satisfied that they have the lawful permission to access such information.

6. How do we store and protect your personal data?

We are committed to protecting your personal data once we have it. We implement physical, business, and technical security measures. Despite our efforts, if we learn of a security breach, we will notify you so that you can take appropriate protective steps.

We also do not want your personal data for any longer than we need it, so we only keep it long enough to do what we collected it for. Once we do not need it, we take steps to destroy it unless we are required by law to keep it longer. Personal data from deactivated accounts is archived for six years in terms of the Postal and Telecommunications Act of Zimbabwe; it is permanently erased from our servers at the lapse of that six-year period.

The data that we store are deleted as soon as they are no longer required for their intended purpose and erasure does not violate any statutory retention periods. Insofar as user data are not deleted because they are required for other legal purposes, the processing of the same is restricted. This means that the data are segregated and not processed for other purposes. This applies, for example, to user data that need to be stored for commercial or tax purposes.

In accordance with statutory regulations, data pursuant to § 257.1 HGB (German Commercial Code) must be retained for six years (annual financial statements, vouchers etc.), and data pursuant to § 147.1 AO (German Revenue Code) must be retained for ten years (books, records, management reports, vouchers, documentation relevant to taxation etc.).

AgriShare may keep non-personal and anonymised data for longer periods for reporting purposes and in situations where laws make it necessary to keep such data.

We store your data on servers located in Zimbabwe, additionally this data is backed up to servers in Frankfurt, Germany. By giving us information, you consent to this kind of transfer of your data. We comply with applicable law and will also abide by the commitments we make in this privacy notice.

7. What are your rights?

Upon request and authentication, we are happy to inform you in writing and in accordance with the applicable law if personal data concerning yourself have been processed. If this is the case, you are entitled to the disclosure of these personal data and of the information listed in detail in § 15 GDPR.

Should the personal data concerning yourself be incorrect, you have the right to immediately demand the rectification of inaccurate personal data or the completion of incomplete personal data (§ 16 GDPR).

You have the right to demand that personal data concerning yourself be immediately deleted insofar as one of the particular reasons listed in § 17 GDPR applies, for example if the data are no longer required for their intended purpose (right to erasure).

You also have the right to demand the restriction of processing if one of the prerequisites listed in § 18 GDPR applies; for example, if you have objected to processing, this will apply for the duration of examination by the controller.

You have the right to object at any time to the processing of personal data concerning yourself for reasons arising from your particular situation. Our company will then cease to process said personal data unless we can prove compelling grounds for the processing or the processing serves to establish, exercise, or defend legal claims (§ 21 GDPR).

Without prejudice to any other administrative or judicial remedy, you have the right to file a complaint with the supervisory authority if you believe that the processing of personal data concerning yourself infringes the GDPR (§ 77 GDPR). You may exercise this right through a supervisory authority in the member state of your place of residence, of your place of employment, or of the place in which the alleged infraction occurred. 8. Cookies and Reach Measurement

Cookies are data which are transmitted from our web server or from third-party web servers to the user's web browser and stored there for future retrieval. Cookies may take the form of small files or other forms of information storage. In accordance with this Privacy Notice, you will be informed of any cookies employed for pseudonymous reach measurement.

We also use the Usercentrics Consent Management Platform service from Usercentrics GmbH. This is a consent management service that lists the purposes of data collection and processing. The collected data cannot be used or stored for any other purpose than these purposes: Compliance with legal obligations, storage of consent. Consent data (granted consent and revocation of consent) is stored for three years. After this period, the data will be deleted immediately or handed over to the responsible person upon request in the form of a data export. 9. Notice to Parents and Legal Guardians

We do not allow children under the age of 18 years to register on the AgriShare. If you are under 18 years of age, we do not want your personal data, and you must not provide it to us. If you are a parent or guardian and believe that your child who is under 18 years of age has provided us with personal data, please contact us to have your child’s data removed.

10. What if we change this privacy notice or any of our privacy notices?

We may need to change this notice and our notices. The updates will be posted online. Your continued use of the product or service after the effective date of such changes constitutes your acceptance of such changes. To make your review more convenient, we will post an effective date at the top of the page.

Terms of Service

These Terms of Service regulate your access to and use of the AgriShare services, along with its related websites, SMS, email notifications, commerce services, and other connected services. By using the AgriShare service, you agree to be bound to the Terms of Service. In these policy documents, “We”/” Our” refers to Welthungerhilfe (WHH) in its capacity as developer and operator of the AgriShare platform, “You”/ “Your” refers to the User who makes use of the AgriShare service.

1. Who May Use the AgriShare Service?

AgriShare is a mobile phone enabled platform that links farmers without assets with commercial or private hiring services for production, processing and transporting. The platform is open to all users permitted by Uganda law to hire out farming related services. The platform is also open to all users permitted by Uganda law to hire or rent farming related equipment or services or resources. This includes users in the form of legal entities such as companies, co-operatives, Trusts, and community-based organisations. In any case, human users must be at least 18 years old. If you are accepting these Terms and using the Services on behalf of a legal entity, you represent and warrant that you are authorised to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” as used in these Terms shall refer to such entity.

2. Privacy

Our Privacy Policy describes how we handle the data generated on the AgriShare platform. Your use of the AgriShare Services means you consent to the collection and use of this information as set out in the Privacy Policy.

3. Using the AgriShare Services

Content
Content shared on the AgriShare services will be in the form of listings, bookings, and messages shared between service providers and prospective lessors of equipment or services or resources. Listings are posts made on the AgriShare services by service providers. Listings may be exclusively text or may be a combination of text and visual media that includes but is not limited to still photographs, video clips, and diagrams.

You are responsible for your use of the Services and for any content you provide, including compliance with laws that apply to the use of that content. We do not guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted on the AgriShare Service. We may monitor and where necessary control the content posted but we are not responsible for postings that are either intentionally or negligently mislabeled or are otherwise deceptive, all content remains the responsibility of the person who originated such content. Users that post content on the AgriShare service retain ownership of that content.

Suspension and/or Termination of Service
We reserve the right to take down content that violates these Terms of Service, including for example, when such content infringes on copyright, harassment, or amounts to harassment. Users are able to report abusive, harmful or illegal content posted on the platform through the ‘contact us’ section on the App and website. We reserve the right to remove or refuse to distribute any content on the AgriShare Services, suspend, or terminate user accounts without liability to you.

We reserve the right to suspend or terminate user accounts that we have sufficient reason to believe are carrying out fraudulent financial transactions on AgriShare services. There is an appeals mechanism set out in the AgriShare Rules.

You may end your legal agreement with AgriShare by deactivating your account and discontinuing your use of the AgriShare Services. Users cannot deactivate their user accounts within 7 business days of pending or outstanding service deliveries and/or payments. The Privacy Policy has information on what happens to your information after you delete your account.

Financial Transactions
By registering, sharing or adding your mobile/airtel money/bank account information you represent and warrant that you are authorised to do so and have the authority to transact with that account. You and we are independent contractors and nothing in these Terms of Service will be construed to create, evidence, or imply any agency, employment, partnership, or joint venture between you and us.

4. Limitations of Liability

To the maximum extent permitted by applicable law, AgriShare shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

your access to or use of or inability to access or use the services;
any conduct or content of any third party on the services, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties;
any content obtained from the services; or
unauthorised access, use, or alteration of your transmissions or content.

We are not liable for any inaccurate, misleading, or fraudulent payment details shared on the AgriShare service. Payments made on AgriShare services are held in escrow until the service provider has completed its services as confirmed by the customer, it remains your responsibility to always transact in a safe and cautious manner. AgriShare will not be liable for any damages arising from transactions carried out by minors. This Agreement does not create or imply any partnership, agency, or joint venture between AgriShare and any users of AgriShare services.

5. General

We may revise these Terms of Service from time to time. The changes are not retroactive, and the most current version of the Terms, will govern our relationship with you. We will notify you of material revisions, for example via a service notification or an email to the email associated with your account. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.

Privacy Policy

This Privacy Policy explains generally how AgriShare services receive information about you, and what we do with that information once we have it. This is in fulfilment of our commitment to being transparent and open.

Definitions

What is your “personal information?”
For us, “personal information” means information that identifies you, like your name or email address. Any information that falls outside of this definition is “non-personal information.”

How do we learn information about you?
We learn information about you when:

you give it to us directly (e.g., when you create an account or input your location);
we collect it automatically through our mobile phone Application (e.g., when the AgriShare Application on your phone connects with our servers for updates, or in download statistics provided by Google Play). Data may be collected when you search for listings, add listings, send and receive notifications and when you make a booking for services and goods listed in the App; For avoidance of doubt, by use of the Application, you consent to such collection of your personal information and
when you add your mobile money account or bank account information (we will only know your account numbers and the transactions you carry out on the AgriShare service)

What do we do with your information once we have it?
Generally, we use your information to help us provide and improve our software and services for you. Your information also helps us connect you to service providers. Non-personal information may be included in AgriShare performance reports, and for AgriShare’s promotional purposes.

When do we share your information with others?
We do not share your information with any third parties. But where the law requires it, for example during a criminal investigation we will be obliged to turn over information that may include personal information to the investigating entities once we are certain that they have the lawful permission to access such information.

How do we store and protect your personal information?
We are committed to protecting your personal information once we have it. We implement physical, business, and technical security measures. Despite our efforts, if we learn of a security breach, to the extent permitted by law we will notify you so that you can take appropriate protective steps.

We also do not want your personal information for any longer than we need it, so we only keep it long enough to do what we collected it for. Once we do not need it, we take steps to destroy it unless we are required by law to keep it longer. Personal information from deactivated accounts is archived for one calendar year; it is permanently erased from our servers at the lapse of the one-year period.

AgriShare may keep non-personal and depersonalised information for longer periods for reporting purposes and in situations where laws make it necessary to keep such information.

How can you manage or delete information about you?
We provide you with the ability to access, rectify, port and erase your data. To learn more, visit the settings on the App.

What else should you know?
We store your information on servers located in South Africa. By giving us information, you consent to this kind of transfer of your information. We comply with applicable law and will also abide by the commitments we make in this privacy policy.

We do not allow children under the age of 18 years to register on the AgriShare service. If you are under 18 years of age, we do not want your personal information, and you must not provide it to us. If you are a parent and believe that your child who is under 18 years of age has provided us with personal information, please contact us to have your child’s information removed.

You may at any time request for a copy of all the information that we have about you. This allows you to check such information for accuracy and where necessary help us correct any inaccurate information we might have on you. We will respond to information requests within a reasonable amount of time that will not exceed 7 business days.

What if we change this privacy policy or any of our privacy notices?
We may need to change this policy and our notices. The updates will be posted online (and/or be printed out at our offices). Your continued use of the product or service after the effective date of such changes constitutes your acceptance of such changes. To make your review more convenient, we will post an effective date at the top of the page.

What are your rights?

Should the personal data concerning yourself be incorrect, you have the right to immediately demand the rectification of inaccurate personal data or the completion of incomplete personal data.

You have the right to demand that personal data concerning yourself be immediately deleted insofar as one of the particular reasons listed in the Data Protection and Privacy Act, 2019, for example if the data are no longer required for their intended purpose (right to erasure).

1. Using AgriShare

These rules shall govern the operation and interaction of AgriShare and its users. In case any of the below stated rules are violated, AgriShare reserves the right to block or delete accounts or take legal action.
AgriShare shall be used for the sole purpose of providing farming and farm related services in Uganda.
The name “AgriShare” may not be used for any other purposes by the users except for the app itself.

2. Listings

Service providers can add their services using the offering option on AgriShare.
Your equipment or resource or service needs to be listed under the categories provided by AgriShare.
All information you give about the offered equipment must be accurate and honest.
You can hide the equipment or resource or service at any time, such equipment or resource or service will not be available for booking until you press the unhide button. Hiding equipment or resource or service does not result in cancelation of already confirmed bookings. Those need to be cancelled manually. Read more in Section 3.
You can delete the equipment or resource or service only if there is no active booking on the equipment. Read more on cancelling bookings in Section 3.
It is your responsibility to ensure that all equipment or resource or service in your listing that is unhidden is available and operational.

3. Bookings

Bookings are done through the seeking section. All details as intended by the seeker are to be entered truthfully.
Information entered by the seeker will be matched with the listed equipment or resource or service. In case of non-availability of the equipment or resource or service, the seeker has the chance to adjust the dates of the requested service.
Once the seeker requests the equipment or resource or service, the equipment or resource or service owner will receive a message that requests confirmation of the availability of the service.
If a service provider fails to confirm a service in three consecutive times, such service provider’s account will be suspended for three months.
Once the service provider has confirmed the service, it shall be the responsibility of the seeker to pay for the service. Failing to pay for a service three consecutive times after having sent a request shall result in blocking the service for three months.
After payment, the equipment or resource or service owner will receive the contact details of the seeker to discuss details of the booking.
Both the equipment or resource or service owner and seeker shall be able to cancel a booking. However, cancelation of an already paid booking shall result in a 5% penalty on the next booking charged on the person who cancelled the booking.
If a booking is cancelled, the seeker shall be able to choose a different booking within AgriShare and the previous amount will be credited to the new booking OR the seeker can request to receive the money back. In the latter event AgriShare will refund the amount within 5 business days.

4. Communication

Before any payment is concluded on AgriShare no direct communication shall be possible between the equipment or resource owner and the seeker.
Once the payment is concluded by the seeker the equipment or resource owner receives the phone number of seekers.
It is the responsibility of all users of AgriShare to always maintain their account details up to date.
AgriShare users can choose the mode of communication with AgriShare on their profile under notification preferences. The modes of communication offered are push notifications, SMS and email.
Users can contact AgriShare at any time through the feedback sections of the App and website. This shall also be used to report any abuses, sensitive content, complaints or any other information that may be relevant for AgriShare or can improve the services offered by AgriShare.

5. AgriShare on your device

The installation of AgriShare is free.
To use AgriShare you need a valid Ugandan phone number.
The installation of AgriShare shall be through Google Play store or any means of phone-to-phone sharing which include but are not limited to ShareIt, Cshare, Bluetooth, Wi-Fi-direct and any other mode of sharing.
Logging out of the application is done by pressing on the “Logout” function listed under the profile section. Logging out does not delete the user account but is rather the temporary exit from a user account within your device. All activity such as bookings remain active even in the event of a logout.

6. Website and app integrations

AgriShare services shall be available on the web and through a mobile phone Application.
The same rules apply for both services.
Equipment or resource listed will be available via both web and app.

7. Managing your account

First time users of the AgriShare service will be required to create an AgriShare account. This requires the submission of the region, user’s name, mobile phone number, date of birth and gender. An email address is required when registering for the Web based AgriShare application only. Please see our Privacy Policy for more information on how data collected on the AgriShare Platform is stored and managed.
It is your responsibility to always keep your account details up to date.
You can choose your preferred mode of communication. If selected, even when logged out or offline you will receive information from AgriShare via SMS, email, call, social media (like WhatsApp), among others.
You can delete your account at any time when there are no pending bookings. If there are pending bookings, you can delete your account after 7 days of last service delivery.

8. Safety, security and complaints

The account shall be protected through your Pin. AgriShare will not at any time ask you to share your pin. Users are reminded not to share their 4-digit pin with anyone.
If you forgot your Pin, you will receive a new verification code on the phone number you registered with AgriShare.
If you take note of any misuse and abuse of your account, please report those immediately through the feedback section on our App or website.
If you receive suspicious emails or SMS from AgriShare, please report those immediately through our feedback section and do not respond to them until AgriShare verified the truthfulness of its content.
The privacy of your data is important to us. Any reports produced and publicized will be de-personalized and will be guided by our privacy policy.
If you have any complaints about our services no matter which nature, please report them to us immediately via the feedback section, email, contact, or social media. We will respond to any request within 5 business days.
